Terms & Conditions for Assetto Corsa, #FordZilla SA Nations Cup

Ford Motor Company of Southern Africa (Manufacturing) (Proprietary) Limited (“FMCSA”) is the promoter of the Competition.

1. About the Competition

FMCSA is launching the FordZilla SA Esports challenge on PC from 23 August to 12 September 2021. As part of the launch FMCSA is giving away prizes for the top three finishers at the end of the final round of the championship.

The winner of the competition will receive the following:

  • GT Vent Shirt, Hypergrip+ Gloves, Hyperspeed Sim Socks, Rebel Cap.

Second place finisher of the competition will receive the following:

  • GT Vent Shirt, Hypergrip+ Gloves, Hyperspeed Sim Socks.

Third place finisher of the competition will receive the following:

  • GT Vent Shirt, Hypergrip+ Gloves.

The name of the competition is #FordZilla SA Nations Cup .  It will be run on Facebook, Twitter and Discord as well as Assetto Corsa on PC. The rules of the competition are explained in Section 2.

2. Rules of the Competition

2.1          This Competition is conducted by FMCSA and is open to everyone except directors, members or partners of FMCSA, FMCSA employees and their immediate families, FMCSA advertising, media and promotion agencies or dealers or any other person who directly or indirectly controls or is controlled by FMCSA or the supplier of goods or services in connection with the Competition.  

2.2          For practical purposes, which will become clearer further below, the competition is open to residents of South Africa only and shall include everybody in possession of a valid South African Identity Document, work or study permit to the extent permissible by law, as long as they  prove that they are resident in South Africa for the time being.

2.3          Participants may enter the competition on Facebook, Twitter or alternative websites carrying the link.  Clicking on the link provided will redirect entrants to the Discord sign-up platform and interface.  

2.4          Participants who have entered the competition will be required to participate in a qualifying session that will remain open from 30 August to 6 September 23:59. Lap times recorded for each player by Assetto Corsa will serve as a seeding process to classify players into correct pools and provide a fair and level playing field. This will give the top 20 drivers a chance of reaching the final round on 12 September.

2.5          The top 3 drivers classified in order at the end of the race will be eligible for prizes and represent South Africa in the FordZilla Nations Cup to be held in November 2021.

2.6          Prizes will be awarded to the top 3 drivers on the final race, 12 September, as per the race results.

2.7          The competition will run from (Monday 23 August 2021, 09:00 – Sunday 12 September 2021, 23:59).

2.8          On (13 September 2021, 09:00), the top 3 results will be announced on FMCSA’s Facebook and Twitter profile.

2.9          The prize(s) or part of the prize(s) cannot be exchanged for cash and are not transferable.

2.10        The game’s results are final and no correspondence will be entered into it.

2.11        By entering this competition, it is agreed that should the Participant be the winner, FMCSA shall have the right to identify the Participant as tothe winner of the competition and have photographs taken which may be published in printed media, or appear on the radio, the internet (including social media), email and/or television. This clause constitutes the participant’s specific granting of FMCSA consent as required by all necessary and relevant legislation including, the Protection of Personal Information Act (No. 4 of 2013)

2.13       FMCSA accepts no responsibility of whatsoever nature for any injury, loss, expense or damage suffered or incurred by any Participant howsoever caused to a winner as a result of participating in this Competition or as a result of accepting any of the prizes. 

2.14        By submitting an entry, Participants accept the above terms and conditions as well as the FMCSA privacy policy.

4. General Competition Conditions

4.1          FMCSA reserves the right to disqualify any Participant who tampers with the entry process or enter the Competition in a way that is fraudulent, misleading, and deceptive or generally damaging to the goodwill or reputation of FMCSA.

4.2          FMCSA reserves the right to disqualify a Participant (including the Prize Winner) if it becomes aware that the Participant is of a type described in this rule or is otherwise in breach of these rules generally.

4.3          The Competition Team reserves the right in its discretion to disqualify any Participant or Potential Participant at any time based on lack of fulfilment of these obligations.

4.4          By participating in the Competition, you agree that no claim shall be asserted against FMCSA, or any of FMCSA’s affiliates, directors, officers, employers or agents in respect of any and all losses or injuries (including without limitation special, indirect or consequential loses), damages, rights, claims or actions of any kind whatsoever that result from your acceptance of.

4.5          All submissions by Participants will become the exclusive property of FMCSA and none will be acknowledged or returned. FMCSA shall have the right to edit, adapt and publish or not publish any or all of the submissions by any Participant, and may use them in any media without attribution or compensation to the Participant, their successors or assigns, or any other entity. CREATING AND SUBMITTING A SUBMISSION IN THIS COMPETITION CONSTITUTES THE PARTICIPANT’S IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANSFERENCE TO FMCSA OF ANY AND ALL RIGHT, TITLE AND INTEREST IN THE SUBMISSION OR ANY DERIVATIVE WORKS CREATED USING THE SUBMISSION INCLUDING, WITHOUT LIMITATION, ALL INTELLECTUAL PROPERTY RIGHTS, INCLUDING COPYRIGHTS. FMCSA grants eligible Participants a limited, revocable, non-sublicensable, license to use FMCSA’s artwork, name, trademarks and logos (collectively, “FMCSA’s Marks”) for the sole purpose of creating and submitting the submission for review and assessment in this Competition. Participants are not permitted to make any further use of FMCSA’s Marks for any purpose whatsoever. In addition, Participants recognize that all right, title, and interest in FMCSA’s Marks, as well as all derivative works,, as well as all derivative works created using FMCSA’s Marks, shall vest exclusively to FMCSA, and Participant agrees that they have not and will not take any action that might harm or adversely affect such rights. No right, title, or interest in and to the FMCSA’s Marks except for the limited license granted to entrant in these Competition Terms and Conditions is transferred or created. Each Participant further acknowledges and agrees that FMCSA’s Marks are valid and enforceable, and that Participant shall do nothing to challenge the validity or enforceability of FMCSA’s Marks in any forum. Participants agree that the use of FMCSA’s Marks is permitted only for the purpose of making a Submission for entry in this Competition and that any use of FMCSA’s Marks (whether in the Submission or otherwise) beyond this scope infringes the rights of FMCSA and will result in irreparable harm to FMCSA.

4.6          By participating in this Competition, Participant grants, assigns, conveys, and transfer all right, title, interest, and ownership throughout the world in perpetuity, including without limitation all copyright and any other intellectual property, and moral rights thereto in the Submission to FMCSA, including without limitation an unlimited, exclusive, royalty-free, non-revocable, worldwide, perpetual right to edit, adapt, and/or publish, make derivative works, and use any and/or all of the Submission for any purpose in any manner or media, now or later known, without limitation, including, but not limited to, the right to sublicense, assign and commercialize the Submission”.

4.7          All participants should all material times ensure that they abide by and do not violate independent rules as stipulated on Twitter and/or Facebook or whatever platform they use to participate in this competition.

5. Additional Rules

5.1          FMCSA is not responsible for any problems or technical malfunction of any computer online systems, servers, or providers, computer equipment, software failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any website, or a combination thereof, including any injury or damage to a Participant’s or any other person’s computer or mobile telephone related to or resulting from participation in relation to the Competition. By participating in the Competition, the Participants agree that no claim relating to any such loss or injury (including without limitation special, indirect or consequential losses) shall be asserted against FMCSA.

5.2          FMCSA reserve the right to withdraw and/or cancel the Competition at any time.

5.3          FMCSA reserves the right to amend the rules of the Competition at any time

5.4          The Competition is governed by the laws of the Republic of South Africa.

5.5          By entering the Competition, the Participants agree to be bound by these terms and conditions. FMCSA reserve the right to modify the content of these terms and conditions should modification be required to ensure the proper execution of the Competition.

5.6          Any breach of the terms and conditions of the Competition may result in disqualification.

6. Acknowledgement by the Participant

Each Participant hereby acknowledges that:

6.1          The Participant has read, and meets and agrees to be bound by, the above eligibility requirements and terms and conditions;

6.2          Subject to applicable law, FMCSA or the Competition Team reserves the right to cancel, terminate, modify these rules or administration of or suspend this event in whole or in part with no obligation or liability, including if for any reason the event is not capable of running as planned, whether due to technical failure, computer virus, tampering, fraud, corruption of security or proper administration of the event or other causes beyond the control of FMCSA or the Competition Team;

6.3          All decisions by FMCSA and the Competition Team concerning the selection of the Participants and the Competition are final and not subject to challenge or appeal; and

6.4          Except for any liability that cannot be excluded by law, the FMCSA and the Competition Team excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition.

7. Participant Consent

By participating, each Participant hereby consents to the recording, use and reuse by FMCSA and the Competition Team and any of their respective licensees, assigns, parents, subsidiaries, divisions, business units, or affiliated entities and each of their respective employees, agents, officers and directors (collectively “Releasees”) of the Applicant’s voice, actions, likeness, name, appearance and biographical material (collectively “Likeness”) in any and all media now known or hereafter devised, worldwide, in perpetuity, in or in connection with the Competition.
